Welcome to Gadjian! This Privacy Notice sets forth Our responsibilities as the Service Provider in processing your personal data as a User. Your privacy is of paramount importance to us, and we are dedicated to ensuring the protection of your personal data in strict accordance with the applicable laws and regulations of the Republic of Indonesia
This Privacy Policy governs the use of Gadjian’s services by all Users, whether registered or unregistered. By accessing and utilizing Gadjian, you acknowledge that you have read, understood, and agree to be bound by the terms set forth in this Privacy Policy. Should you disagree with any provision herein, you are kindly requested to refrain from using Gadjian’s services.
We may from time to time amend or update this Privacy Policy. Any such changes will become effective immediately upon posting on our platform. It is your responsibility to review this Privacy Policy periodically. Your continued use of Gadjian’s services after any modifications shall constitute your acceptance of, and agreement to comply with, the revised terms.
GENERAL INFORMATION
1. Gadjian is a digital platform and/or cloud-based software as a service (SaaS) designed to function as an integrated solution for human resource management and payroll administration, inclusive of various ancillary features.
2. User or You is any individual, corporation, or legal entity duly registered and utilizing Gadjian, including but not limited to employees, administrators, and business owners.
3. Service Provider or We is PT Fatiha Sakti, the operator and owner of Gadjian.
4. Personal Data means any data or information that can identify an individual, either directly or indirectly, including but not limited to name, address, identification numbers, contact information, employment data, and biometric data in relation to the use of Gadjian’s services.
DATA WE COLLECT
1. Identity Data
We collect individual identity data comprising, without limitation, full name, username, email address, gender, place and date of birth, national identity card, driver’s license or passport details, taxpayer identification number, educational background, professional details, and other identifying particulars.
2. Business Entity Data
We collect business-related information, including but not limited to the Business Identification Number (Nomor Induk Berusaha/NIB), business licenses, Taxpayer Identification Number (NPWP), corporate bank account details, legal entity structure, and other relevant corporate or regulatory data.
3. Technical Data
We collect and process technical information comprising, without limitation, Internet Protocol (IP) address logs, browser and device specifications, operating system details, and visitor analytics for legitimate purposes including system performance analysis, cybersecurity enhancement, and service optimization. In addition, the Platform implements tracking technologies such as cookies and equivalent tools to record user interactions and behavioral patterns for the purpose of enhancing usability and personalization. Users retain the right to disable or reject cookies through browser configurations; however, such actions may limit certain features or degrade the quality of the services provided.
4. Activity Log Data During Use of Gadjian
We collect detailed records of user interactions conducted within the Gadjian platform. This encompasses access metadata such as IP addresses, data entries and updates, system-generated logs of user communications, and all traceable operational activities occurring throughout the course of platform utilization.
HOW WE USE YOUR DATA
We process your Personal Data exclusively for purposes directly connected to the operation and provision of the Gadjian services. The collection is limited to what is necessary and proportionate in support of the following lawful objectives:
a. Delivery, operation, and continuous maintenance of the Gadjian platform and its core functionalities
b. Facilitation of user account activation, service registration, and related operational processes such as transactions and payment execution.
c. Provision of notifications regarding system activities, updates, or relevant information concerning Gadjian and any affiliated or integrated services.
d. Enablement of supplementary services that interface with Gadjian, subject to your explicit consent or operational necessity.
e. Execution of identity verification processes to mitigate fraudulent activity and prevent unauthorized system access.
f. Communication of tailored advertising, promotional materials, or marketing messages relevant to Gadjian or other applicable offerings, distributed via multiple channels including, but not limited to, the platform, SMS, messaging applications (e.g., WhatsApp), push notifications, phone calls, and emails.
g. Analysis of service usage, system performance monitoring, and the ongoing maintenance and enhancement of the Gadjian platform.
h. Fulfillment of legal, administrative, and reporting obligations mandated under applicable laws and regulations.
You retain the right to withdraw your consent at any time by contacting the Data Controller (i.e., your employer or account administrator), or by reaching out to us through the “Contact Information” section as outlined in this Privacy Notice.
DATA STORAGE
We safeguard all your Personal Information and Data employing the highest standards of protection, including encryption and other appropriate security measures, for as long as retention is necessary for our purposes.
Certain Personal Data may also be processed, managed, and stored by third-party service providers collaborating with Gadjian, located within and/or outside the territory of Indonesia, to ensure optimal service performance while adhering strictly to applicable data protection principles and regulations governing access and supervisory effectiveness. You acknowledge and consent that such Personal Data may be handled by third parties operating outside Indonesia, provided that they maintain a level of data protection equivalent to or exceeding the standards mandated under Indonesian data protection laws.
We retain Personal Data for the duration necessary to fulfill the purposes for which it was collected, throughout your active use of Gadjian’s services, or in accordance with Gadjian’s data retention policies and applicable legal requirements.
DATA DISCLOSURE
We may disclose or provide access to your Personal Data to our affiliates and third parties exclusively for the purposes set forth herein, as well as for any other purposes expressly authorized under applicable laws and regulations:
a. Facilitating the provision of Gadjian’s services, inclusive of any functionalities necessitating the processing of your Personal Data;
b. Executing requisite identity verification and due diligence procedures prior to onboarding you as a User or delivering services to you;
c. Disclosing to affiliates or third parties (including agents, vendors, suppliers, contractors, partners, and other entities rendering services to us or to you, or those with whom we engage in commercial arrangements), strictly for the fulfillment of roles and responsibilities entrusted to such Third Parties, and to effectuate disclosures technically indispensable for processing your transactions or effectuating our contractual collaborations. Such disclosures may encompass authorizing these Third Parties to present or offer products and services to you, authenticate your identity, associate you with your accounts, or conduct ancillary activities including but not limited to marketing, research, data analytics, and product innovation;
d. Engaging affiliates or third-party service providers to support the operation of Gadjian, our business processes, marketing initiatives, risk evaluation and mitigation, as well as data processing on our behalf in compliance with applicable law;
e. Facilitating interoperability and integration with third-party platforms to enable seamless acquisition of your Personal Data, registration, or enhancement of your user experience across interconnected services;
f. Complying with binding requests or mandates issued by governmental authorities, regulatory agencies, or pursuant to judicial orders, whereby we disclose requisite Personal Data to ensure adherence to applicable legal and regulatory obligations.
We categorically affirm that we do not engage in the sale or rental of your Personal Data.
Except as explicitly articulated in this Privacy Notice, disclosure or sharing of your Personal Data will be conducted solely upon prior notification to you or following acquisition of your explicit consent.
USER RIGHTS
1. Access and Modification
You retain the right to access and update your personal information at any time. Such actions may be performed by logging into your account and effectuating the necessary amendments.
2. Deletion
You retain the right to request the deletion of your personal data by contacting Us through the contact details stipulated in this Privacy Policy. Notwithstanding such requests, We may continue to retain your data as necessary to fulfill legal obligations, resolve disputes, or ensure the continuity and stability of Our services.
3. Withdrawal of Consent for Data Use
You acknowledge that upon submitting a withdrawal request, your access to Gadjian’s services may be restricted or terminated. Such withdrawal of consent shall result in the suspension or termination of your account or contractual relationship with Us, subject to the rights and obligations arising therefrom which must be duly fulfilled.
4. Filing a Complaint
In the event of any inquiries, concerns, or disputes pertaining to the processing of your Personal Data, or should you wish to provide relevant information regarding User Personal Data, you are entitled to formally submit a complaint in accordance with the procedures stipulated herein.
We reserve the right to refuse your request for access to, correction of, and/or deletion of, in whole or in part, your Personal Data under our control or authority, in accordance with the applicable Laws and Regulations.
This includes requests for access, correction, or deletion deemed by us to be irrelevant, frivolous, unfounded, or indicative of a breach of the Terms of Use or involvement in unlawful activities.
DATA SECURITY
Your data security is our priority. We are committed to protecting your personal information by implementing the following measures:
1. Utilizing advanced security technologies to protect your personal data from unauthorized access, use, alteration, and destruction;
2. Securing the data we collect through encryption, ensuring that only the account owner can access the data;
3. Backing up your data to multiple servers in different locations. Data backups are performed 7 days a week;
4. Keeping logs of all access to your account, whether by yourself, administrators, or unknown parties;
5. You are responsible for keeping your account credentials confidential and not sharing them with others. Please notify us immediately if you suspect any unauthorized access to your account; and
4. We ensure that our data security measures comply with applicable data protection laws and regulations in Indonesia, to guarantee the protection of your data.
DATA RETENTION
Your Personal Data shall be retained solely for the duration necessary to fulfill the Purposes of its collection and/or as required or permitted under the Applicable Laws and Regulations. We shall delete your Personal Data promptly upon the termination or expiration of the service, at which point your data will no longer be accessible to Users. Should the service period not be renewed, your data will be permanently removed from our database within one hundred (100) calendar days following the subscription payment due date for Gadjian.
Please note that certain Personal Data may continue to be retained or controlled by third parties, including governmental institutions, under specific arrangements. In the event we disclose your Personal Data to authorized government bodies and/or other institutions designated by or cooperating with the government, you hereby consent and acknowledge that such retention by the respective institutions or third parties shall be governed by their own data retention policies.
To the extent permitted by the Applicable Laws and Regulations, you hereby release and hold harmless Gadjian from and against any and all claims, losses, liabilities, costs, damages, and expenses (including but not limited to attorneys' fees and full indemnification costs) arising directly or indirectly from any activities conducted outside the scope of Gadjian’s services.
GOVERNING LAW
This Privacy Policy is governed by and shall be construed in accordance with the laws of the Republic of Indonesia.
